Apprentices - Method for calculating rates of pay

REASONS FOR DECISION

This application was made by the Tasmanian Confederation of Industries (TCI) requesting a hearing for the purpose of amending the provision relating to wage rates for apprentices contained in Clause 8, Division A, subclause 3(a) of the Mechanical Engineers and Founders Award.

The current provision states that an apprentice shall receive a certain percentage of the rate applicable to classification "level 5A of the Mechanical Stream" appearing in the award.

The TCI sought in this matter to more precisely define the abovementioned level by using the words "the Base Rate of level 5A of the Mechanical Stream".

My reasons for granting this application are:

(1)  It only seeks to clarify an existing provision in the award.

(2)  It is not inconsistent with the Principles.

(3)  There was no opposition from any party to the award.

That being the case the award will be varied in the manner sought, operative from the first full pay period to commence on or after 4 July 1991.

The order giving effect to this decision is attached.
