Award variation - Clause 19 - Hours of Employment

REASONS FOR DECISION

In this matter the Metals and Engineering Workers Union (MEWU) sought the variation of the Draughting and Technical Officers (Private Industry) Award to include a new subclause in Clause 19 - Hours of Employment - to reflect the method of implementation of the 38 hour week in individual work places.

Whilst the award already contains provisions setting out the options for the working of a 38 hour week, the variation now requested by the MEWU would facilitate consultation between employer and employees on the arrangements for working those hours in each establishment.

I would have thought that consultation on how a 38 hour week was going to be worked would be commonplace and certainly in the interests of best industrial practice. However that may be in respect of employers subject to this award, the proposed variation formalises that approach and I endorse it.

The variation to the award going to the deletion of Clause 24 - Notification of Classification - was not pursued by the MEWU. The reason for this was that the notification of classification to individual employees will continue given that two distinct classification structures currently operate in the award.

That is the structure in the award prior to structural efficiency variations1 will continue to operation alongside the new classification structure until it is phased out in April 1992. Until then, as both structures may be utilised it is desirable for employees to be notified the classification that they currently hold.

The order, operative from the date of this decision, is attached.
