REASONS FOR DECISION

This application seeks the second structural efficiency increase given the agreements reached to date between the parties to this award and the advanced progress towards the finalisation of the new industry award.

Arising out of application T.2012 of 1989 the Commission, in its decision dated 21 June 1990, established a new award to be known as the Fish, Aquaculture and Marine Products Award. This award will eventually replace the Poultry, Game and Marine Products Award. At the time submissions were presented to make that new award the Australian Workers' Union, Tasmanian Branch informed the Commission that it was part of their structural efficiency programme for this industry and they were of the opinion that it would fulfil the Unions commitment to award restructuring as well as making an award more specific and relevant to the industry of producing and processing fish aquaculture and marine products.

On 2 May 1991 the hearing of application T.2012 of 1989 reconvened to hear further submissions from the parties in relation to the contents of the new industry award. On that occasion it seemed from the evidence presented that the parties were addressing all the relevant issues required to be considered in accordance with the Structural Efficiency Principle.

The parties during this hearing requested the Commission to place the second structural efficiency increase into the Poultry, Game and Marine Products Award given that they were so far down the track in relation to making the new award.

It was stated that the Unions have clearly committed themselves to award restructuring for the industry and that was clearly demonstrated during the course of hearing application T.2012 of 1989.

It was the Unions' submission that given their commitment they should not be required to wait any longer for the second structural efficiency increase.

Having considered the submissions of the parties which were uncontested I have arrived at the conclusion that the Poultry, Game and Marine Products Award should be varied to reflect the second structural efficiency increase on the basis that the current process to establish a new award to cater for the needs of the industry is certainly in line with the Structural Efficiency Principle and that award has been progressed to a sufficient stage to warrant the increase.

The operative date will be that agreed to by the parties being the first full pay period on or after 20 May 1991.

The orders giving effect to this decision are attached.
