REASONS FOR DECISION

This is an award interest determination referred to me by the President under Section 63(1) of the Act.

The Australian Workers' Union, Tasmania Branch (the Union) sought an interest in the Clay and Mud Products Award. There were no objections to the application.

Mr D Hayes appeared for the Union and sought the granting of the interest in the Award.

I am satisfied that the Union, being already registered with the Commission and having members covered by the Award has met the requirements of Section 63(10) of the Act in that:

  • it has members covered by the Award;

  • those members are eligible to be members under the rules of the Union; and

  • the granting of interest would not prejudice the orderly conduct of industrial relations in Tasmania.

I therefore determine that the Union has an interest in the Award.

A copy of this determination will be forwarded to the Registrar as required by Section 65A(6) of the Act.

An order operative from the date of this decision is attached.
