Award variation - parties and persons bound

REASONS FOR DECISION

In this matter the Health Services Union of Australia, Tasmania No. 2 Branch (HSU) made application to vary Clause 6 - Parties and Persons Bound, of the University of Tasmania General Staff Award to delete reference to the Health and Research Employees' Association of Australia (HAREA) and replace it with the HSU.

The application was made consequential to the amalgamation of HAREA and the Hospital Employees Federation to form the Health Services Union of Australia. The amalgamation was approved by Deputy President Moore in the Australian Industrial Relations Commission with effect from 1 January 1991. Subsequently the cancellation of the registration of HAREA was granted by a Full Bench of this Commission which enabled the Registrar to make the necessary name changes to the employee organisations subject to the amalgamation.

Accordingly, the HSU became a registered employee organisation in this Commission operative from 1 January 1991. Given that HAREA is defunct and the HSU is a registered employee organisation in accordance with the provisions of the Industrial Relation Act 1984, the award will be varied in the manner requested operative from 1 January 1991.
