(T.3131 of 1991)

MISCELLANEOUS WORKERS (PUBLIC SECTOR) AWARD

COMMISSIONER P A IMLACH

7 August 1991

Award - scope

REASONS FOR DECISION

This was an application under Section 23 of the Act made by the Federated Miscellaneous Workers Union of Australia, Tasmanian Branch (the Union) for an amendment to the scope clause of the Miscellaneous Workers (Public Sector) Award (the Award).

At the hearing, the Union submitted that the scope clause needed to be amended so that the names of the State Government departments listed there (previously called agencies) coincided with the departments now existing. There was a restructuring of departments soon after the present Government acceded to power in 1989.

The Union advised the Minister Administering the State Service Act 1984 (the Minister) had agreed to the omission of the departments no longer existing and the inclusion of the new departments.

The Minister confirmed his agreement to the proposed variation.

The award will be varied as sought operative from the date of this decision. An order is attached.
