Structural Efficiency Principle - first minimum rates adjustment

REASONS FOR DECISION

This matter concerns an application by The Association of Professional Engineers, Australia, Tasmanian Branch, (APEA), to vary the Professional Engineers (Private Industry) Award by applying the first minimum rates adjustment in accordance with current Wage Fixation Principles.

The APEA supported its application by pointing out that it had honoured its commitment to the Commission not to pursue claims outside of those permitted by the Principles and tendered details of how such amounts of supplementary payments have been calculated, based upon the ultimate achievement of properly fixed relativities to the common rate for a tradesman. The first instalment represents 25% of the rate achieved following the granting of the "second structural efficiency" increase and the final percentage figure.

Mr Pyrke of the APEA gave an undertaking that, where overaward payments occurred, absorption, to the extent necessary, would apply.

The Tasmanian Confederation of Industries consented to the variation on the basis that the APEA is not pursuing Accord Mark VI claims.

I am satisfied that the terms of the application meet the requirements of Section 36 of the Act and Wage Fixation Principles.

For these reasons the application is granted.

OPERATIVE DATE

This variation shall have effect from the first full pay period to commence on or after 29 July 1991.
