Industrial Relations Act 1984
s.23 application to vary an award

Transport Workers' Union of Australia,
Tasmanian Branch

(T.3162 of 1991)

TRANSPORT WORKERS GENERAL AWARD

COMMISSIONER P A IMLACH

5 August 1991

Wage Rates - State Wage November 1989 - minimum rates adjustment

REASONS FOR DECISION

This was an application made under Section 23 of the Act by the Transport Workers' Union of Australia, Tasmanian Branch (the Union) for the second minimum rates adjustment (MRA) to be implemented in the Transport Workers General Award (the Award) in accordance with the current Wage Guidelines.

At the hearing the Union produced exhibits showing the proposed sequential implementation of MRA's outlined by the parties and endorsed by the Commission in matter T.2894 of 1990. This application simply sought for the second step in that process to be approved by the Commission.

In addition to the second MRA increase, the Union also sought to correct a previous omission by increasing the late payment of wages allowance provided in clause 29 - Payment of Wages of the Award by 6% in accordance with the first Structural Efficiency Principle (SEP) increase of 3% and the second SEP increase of a further 3%.

The Union sought for both the second MRA and the corrected increases to operate from the first full pay period commencing on or after 1 September 1991, the date endorsed in matter T.2894 of 1990.

The Tasmanian Confederation of Industries (the Confederation) indicated agreement to the Union's application including the corrections sought in Clause 29 of the Award.

As indicated at the hearing the claims of the union, both parts in effect having been previously approved by the Commission, are endorsed.

The consequent amendments to the Award will operate from the first full pay period commencing on or after 1 September 1991.
