Wage Rates - minimum rates adjustment - second increase

REASONS FOR DECISION

This was an application made under Section 23 of the Act by The Federated Miscellaneous Workers Union of Australia, Tasmanian Branch (the Union) for the implementation of the second minimum rates adjustment (MRA) in the Cleaning and Property Services Award (the Award).

At the hearing the Union in seeking the second MRA for the Award referred to the settlement between the parties in matter T.2851 of 1990 whereby the first MRA was implemented and the manner of implementation for all the others confirmed.

The Union also sought for the increases involved to operate from six months after the date of operation of the first MRA, 21 June 1991.

The Tasmanian Confederation of Industries (the Confederation) confirmed its agreement to the second MRA as claimed, but pointed out that:

  • such increase should be fully absorbed in any over-award payments current paid; and

  • the operative date for the second MRA should be the date of decision in this matter. The Confederation submitted that the Wage Principles required only that each MRA become available every six months and then payable only after a separate application for each increase by the Union.

The Confederation also produced as an exhibit a draft order showing the resultant weekly supplementary payment to be prescribed separate in the Award for each of the three grades of Property Service Employees.

I am satisfied that this second MRA for the Award should be implemented as all the Wage Principles requirements originally confirmed in matter T.2851 of 1990 have been fulfilled in this specific application.

The Award amendment will operate from the first full pay period commencing on or after the Union's application, 8 July 1991.  Order
