Deletion of Division B - Clerks

REASONS FOR DECISION

This application was made by the Federated Clerks Union of Australia, Tasmanian Branch (F.C.U.) for the purpose of removing wage rates and conditions of employment for clerks appearing in the Vegetable Preservers Award.

The parties presented an agreed position in respect to this application.

The effect of deleting the provisions for clerks from this award will mean employers in this industry will now be required, when employing clerical/administrative employees, to observe the provisions contained in the Clerical and Administrative Award.

No submission was put to me that would have me conclude that this course of action was against the Wage Fixing Principles or the Public Interest requirements of the Act. Therefore the application is granted and the award will be varied in the manner sought by the parties.

Given this decision, I now require the F.C.U., Tasmanian Branch to make application in accordance with section 65 of the Industrial Relations Act 1984 to have their interest in the Vegetable Preservers Award withdrawn.

The Order giving effect to this decision will be issued when the Section 65 application has been finalised and it will be operative from the first full pay period to commence on or after 5 September 1991.
