Parties and persons bound - change of name

REASONS FOR DECISION

This was an application made under Section 23 of the Act by the Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch (The Federation) for variations to be made to nominated private sector awards and an agreement to reflect changes of names following the amalgamation of The Federated Ironworkers' Association of Australia, Tasmanian Branch and the Australasian Society of Engineers, Tasmanian Branch.

The application follows matter T.3183 of 1991 in which the amalgamation was notified to the Commission and to facilitate the process, the registration with this Commission of one of the two former parties to the amalgamation was cancelled. Then, as foreshadowed in that decision this application was made for all the relevant awards and an agreement to be varied to delete the former names and insert the name of the Federation.

During the hearings the Federation sought and was granted leave to withdraw that part of the application relating to the Clay Products Award and the RACT Agreement.

The Federation also confirmed that it sought only to cover those areas previously covered by each of the two former unions where one or other had limited coverage in an award: in particular the Quarrymens Award and the Concrete Products Award were mentioned.

The Australian Workers' Union, Tasmania Branch appeared at the hearings and after prior discussions with the Federation and hearing its submissions confirmed its support for the name changes.

The Tasmanian Confederation of Industries was unable to attend the final hearing, but sent a letter to the Commission (which was read into transcript) confirming its agreement to the Federation's application, as amended.

I am satisfied that this application has been properly made and it is in the public interest that the names be changed as sought. I therefore grant the application.

It will be left for each Commissioner responsible for the relevant awards to draft and issue the orders which will operate from 2 August 1991.
