TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 National Union of Workers CHEMISTS AWARD
State Wage Case August 1991 - 2.5% increase - granted REASONS FOR DECISION This matter concerns an application by the National Union of Workers to vary the Chemists Award by increasing wage rates and appropriate allowances by 2.5%. The matter is one of consent and I am satisfied on the material and evidence before me, details of which are contained on transcript, that the application is justified on all relevant criteria. In particular there has been compliance with the revised Principles of Wage Fixation determined by the State Wage Case1 Full Bench decision of 13 August 1991. The parties have produced evidence of compliance with item 2, Structural Efficiency, (a) to (g) inclusive. There has also been a commitment given by all unions concerned in the following terms: "It is a term of this award (arising from the decision of the Tasmanian Industrial Commission in the State Wage Case of 13 August 1991) that the union(s) undertake(s), until 30 November 1991, not to pursue any extra claims, award or overaward, except when consistent with those principles." That commitment will be verified in writing and shall form part of the terms of the award. Having been satisfied that in accordance with Section 36 of the Act, and item 3, Structural Efficiency Adjustment, that a proper case has been made out I have decided to grant the application and vary the award accordingly. I also am prepared to recommend that over-award payments be similarly adjusted upwards by 2.5% Operative Date This variation shall have effect from the first full pay period to commence on or after 28 August 1991. Order The parties are to prepare a draft order and submit it to the Commission. Order
