Wage rates - State Wage August 1991 - Structural Efficiency Principle

REASONS FOR DECISION

These applications, which were joined at the outset, were made under Section 23 of the Act by the unions party to the Optical Industries Award (the Award) for the August 1991 State Wage decision (the decision) 2.5% increase to be applied to the Award.

At the hearing the Unions, lead by the Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch (FIMEE) canvassed all the relevant items in the decision and then submitted that not only had all the general requirements of the Structural Efficiency Principle (SEP) been met, but the specific requirements had also been met: in other words there was no need at all to amend the Award further.

The Unions sought for the increase to operate from the first full pay period commencing on or after 9 September 1991.

The Tasmanian Confederation of Industries (the Confederation) confirmed its agreement to the union's claims on the basis that the SEP process in the Award had proceeded adequately so far. The Confederation advised that the matter of penalties was yet to be addressed in the Award.

The Confederation also agreed to the claimed operative date.

I am satisfied that the SEP process has been adequately applied to the Award and that all the requirements of the decision for the granting of the 2.5% increase have been met.

All the unions involved having submitted the appropriate letters of commitment under the new Wage Principles, the Award will be amended as requested: all wage rates and work related allowances will be increased by 2.5% to operate from the first full pay period commencing on or after 9 September 1991.
