TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

The Tasmanian Registered Teachers' Association
(T.3248 of 1991)

INDEPENDENT SCHOOLS (TEACHERS) TASMANIA AWARD

DEPUTY PRESIDENT A. ROBINSON

HOBART, 2 September 1991

State Wage Case August 1991 - 2.5% increase - granted

REASONS FOR DECISION

This matter concerns an application by The Tasmanian Registered Teachers' Association (the Association) to vary the Independent Schools (Teachers) Tasmania Award by increasing wage rates and work-related allowances by 2.5% appropriately rounded off.

The application relies upon compliance with the criteria established by the State Wage Case Full Bench decision1 of 13 August 1991 and the revised Principles of Wage Fixation attached thereto.

The Association has provided the Commission with a written commitment to be inserted in the award in the following form:

"PROVIDED ALWAYS that it is a term of this award (arising from the decision of the Tasmanian Industrial Commission in the State Wage Case of 13 August 1991) that the union undertakes, until 30 November 1991, not to pursue any extra claims, award or overaward, except when consistent with those principles."

Submissions put to the Commission during the course of the hearing showed that there has been constructive consultations on an ongoing basis between representatives of employees and employers, resulting in there being no opposition to the granting of the present application.

The Commission was, reminded of the details of structural efficiency measures which have already been implemented as part of the earlier concluded 'Special Case' proceedings2 followed by a report back hearing concerning ongoing matters, and the endorsement by the Commission of an Agreement3.

Each of the criteria of Principle 2 - Structural Efficiency - items (a) to (g) inclusive, were addressed in detail, and as a consequence I am satisfied that such criteria has been satisfied.

I am also satisfied that to grant the application would be consistent with the requirements of Section 36 of the Act - public interest.

Accordingly the application is granted and the award will be varied by increasing wage rates and work-related allowances by 2.5%, appropriately rounded off.

Date of Operation

The foregoing variation shall have effect from the first pay period to commence on or after 1 September 1991.

Order will follow. [Correction Order]
