Wage rates - State Wage August 1991 - Structural Efficiency Principle

REASONS FOR DECISION

This was an application made under Section 23 of the Act by the Federated Clerks Union of Australia, Tasmanian Branch (the Union), for the August 1991 State Wage Case decision (the decision) 2.5% increase in wages and work-related allowances to be applied to the Insurance Award (the Award).

The Union, in its submissions at the hearing, canvassed the requirements of the Structural Efficiency Principle (SEP) in the decision and indicated that (except for sub-paragraph (e) of the SEP) all had been met in the Award.

As to sub-paragraph (e) the Union produced as an exhibit a draft amendment order applying to Clause 14 of the Award and sought that change as part of its application.

The matter of the Minimum Rate Adjustment (MRA) process as specified in sub-paragraph (g) of the SEP was left by the Union for the employer representative to report on.

The Union confirmed that its letter of commitment under the Wage Principles had been forwarded to the Commission previously and sought for the increases to operate from the beginning of the first full pay period commencing on or after 9 September 1991.

The Tasmanian Confederation of Industries (the Confederation) confirmed its agreement to the application on the basis that the SEP requirements had been met. It advised also that, as previously notified to the Commission, a new classification structure negotiated in the context of the SEP was soon to be put forward for the Award.

The new structure had been successfully implemented and tried in the workplaces (without contravening the current provisions of the Award). An MRA implementation scheme was expected to be included in that future proposal.

The Confederation also confirmed agreement to the operative date sought.

As indicated at the hearing I am satisfied that the parties have complied with the requirements of the SEP in all respects and the Award will be amended by increasing all wage rates and work-related allowances by 2.5% operative from the first full pay period commencing on or after 9 September 1991.
