Wage rates - State Wage August 1991 - Structural Efficiency Principle

REASONS FOR DECISION

These applications, which were joined at the outset, were for the August 1991 State Wage Case (SWC) decision 2.5% increase to be implemented in the Quarrymens Award (the Award) and for the deletion of all references to clerks in the Award.

The principal union involved, the Australian Workers' Union, Tasmania Branch (the AWU) in support of its application, submitted that the requirements of the Structural Efficiency Principle (SEP) in the SWC decision had been met almost completely in the Award by the changes brought about with the second SEP 3% increase previously. The one outstanding item related to consultative mechanisms in the Award and this was remedied by means of a draft new structural efficiency clause.

The AWU also confirmed that the minimum rates adjustment process was under way and that it had submitted its commitment in accordance with the SWC decision.

A draft order was also produced showing the application of the 2.5% increase to all wage rates and work-related allowances prescribed in the Award. The AWU sought an operative date of the first full pay period commencing on or after 12 September 1991.

The other two unions present at the hearing, the Federated Clerks Union of Australia, Tasmanian Branch (the FCU) and the Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch (FIMEE) both supported the submissions of the AWU and the operative date sought. The FCU, in line with its application requested the deletion of any reference to clerks in the Award.

Both unions also confirmed that the required commitments had been delivered to the Commission.

The Tasmanian Confederation of Industries advised its consent to the applications and the operative date confirming that all the SEP requirements had been met.

As indicated at the hearing I was satisfied that the requirements for the SWC decision had been met as to the SEP and the commitments of the unions: the award will be varied operative from the first full pay period commencing on or after 12 September 1991.
