TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of an award

Federated Clerks Union of Australia
Tasmanian Branch

(T3415 of 1991)

CLERICAL AND ADMINISTRATIVE EMPLOYEES (PRIVATE SECTOR) AWARD

PRESIDENT F. D. WESTWOOD

9 OCTOBER 1991

Award variation - Superannuation clause

REASONS FOR DECISION

This application, which has the support and consent of the employer, seeks to rationalise the employers' responsibilities for occupational superannuation in the event that clerical employee classifications are deleted from other awards of this Commission and as a consequence fall under the "general application" of this award.

The proposal also protects the employees' position in respect of contributions already made.

The proposed variation will remove the need to follow the painstaking process of seeking exemptions to enable employers to contribute to company or other alternate approved funds which have been ratified in accordance with the provisions of other awards.

I consider the application is reasonable and appropriate and the award will be varied to reflect the wishes of the parties with effect from today's date.

The necessary order is attached.
