T3440 and T3442
TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Federation of Industrial, Manufacturing and Engineering Employees
Parties and persons bound - change of name REASONS FOR DECISION These applications, which were joined at the outset, made under Section 23 of the Act by the Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch (the Federation) were for variations to be made to the Dairymen's Award and the Carriers Award to reflect a change of name following the amalgamation of The Federated Ironworkers' Association of Australia, Tasmanian Branch (the FIA) and the Australasian Society of Engineers, Tasmanian Branch (the ASE). Previously in matter T3183 of 1991, the amalgamation was notified to the Commission and, to facilitate the process, the registration with this Commission of one of the two former parties to the amalgamation (the ASE) was cancelled and the name of the other former party (the FIA) was changed to that of the Federation. Then, as foreshadowed in the decision in that previous matter, an application was made (T3182 of 1991) for all the relevant Awards to be varied to delete the former names and insert the name of the Federation. By mistake two awards were omitted from the list of awards applied to be varied in that last matter. These applications seek merely to remedy the mistaken omission. I am satisfied that these applications have been properly made and it is in the public interest that the name be changed as sought. I therefore grant the application. It will be left for the Commissioner responsible for each award to draft and issue the order which will operate from 2 August 1991.
