Cancellation of award interest

REASONS FOR DECISION

All references to clerks and the Federated Clerks Union of Australia, Tasmanian Branch (FCU) were deleted from the Laundry and Dry Cleaning Award in matter T.3409 of 1991.

As a consequence the FCU requested the Registrar, pursuant to Section 65A(1) of the Industrial Relations Act 1984 (the Act) to make application to the President for leave to recall the FCU certificate of registration on the ground that the FCU no longer had an interest in the Laundry and Dry Cleaning Award. The President referred the matter to me for determination as provided for in Section 65A(2).

At the ensuing hearing Mrs Dowd for the FCU submitted that as all references to clerks had been deleted from the award it would be appropriate for the Commission to determine that it no longer had an interest in the Laundry and Dry Cleaning Award. I concur with that submission and determine accordingly. A copy of this determination has been forwarded to the Registrar as required by Section 65A(6) of the Act.
