Wage rates - Third Minimum Rates Adjustment - Application Granted - Operative Date F.F.P.P. on or after 1 November 1991

REASONS FOR DECISION

The decisions arising out of applications T.No's. 2940, 3020 and 2979 of 1991 varied the Plumbers Award and the Building Trades Award to reflect the second Minimum Rates Adjustment in accordance with the Wage Fixing Principles. The operative dates of those decisions was from the first full pay period on or after 1 May 1991.

These applications seek the third Minimum Rates Adjustment from the first full pay period on or after 1 November 1991.

Exhibits were presented showing the agreed position of the parties, however, during the hearing dealing with the first Minimum Rates Adjustments the Unions agreed that increases in wage rates arising out Minimum Rates Adjustments could be absorbed against existing over award payments and that no action will be taken by them to re-establish pre-existing level of over award payments. This agreement also applies to this and future Minimum Rates Adjustments.

I am satisfied that the Minimum Rates Adjustment agreement presented by the parties complies with the Wage Fixing Principles and the Public Interest requirements of the Act. As a result I am going to grant the applications in the manner sought by the parties including the operative date.

The order giving effect to this decision is attached and I take this opportunity to remind the parties that the fourth instalment of the Minimum Rates Adjustment will not be automatic and will require a separate application.
