Award - rescission of award

REASONS FOR DECISION

These applications made by the Minister Administering the State Service Act 1984 (the Minister), which were joined at the outset, were for the rescission of the Supervisory and Technical Staff Government Printing Office Award and the Printing Staff - Government Printing Office Award (the Awards).

In support of the applications the Minister cited three reasons:

  • There were no longer any Government employees covered by the Awards.

  • On 30 August 1991 in matter T.2646 of 1990, a new award had been made, the Government Printing Office Production Staff Award, which also obviated the need for the Awards.

  • The rationalisation and reduction in the number of awards, as in this case, are exactly the processes envisaged by the current Wage Guidelines.

The Minister submitted that the Commission is empowered under Section 22(7) of the Act to rescind the Awards and, furthermore, that Section was availed of by other members of the Commission to rescind awards1.

There was no opposition to the applications. The Tasmanian Public Service Association did not appear at the hearing, but advised beforehand that it had no objection to the applications.

As indicated at the hearing, I endorse the Minister's submissions and the Awards will be rescinded.
