TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 National Union of Workers, Tasmanian Branch and Campbells Cash and Carry Pty Ltd
Termination of employment - redundancy payments REASONS FOR DECISION This notification of dispute sought the Commission's assistance in resolving the issue of appropriate redundancy payments to be made to employees of Campbells Cash and Carry Pty Ltd, a wholesaler operating at Moonah. On the first day of hearing the Commission was informed that some employees had already had their services terminated by the company, effective from 8 November 1991, and that it was possible that the company would cease operations altogether. After allowing the parties some time in private conference, the Commission was advised that a package had been developed which would be put to the company's board of directors for approval. I recommended that the Board give favourable consideration to the package and at the request of the parties the matter was adjourned until 14 November 1991. That hearing did not proceed given the union's request that the Board should have more time to consider the proposal. A further hearing was set down for 28 November 1991. Prior to that hearing I was informed by letter from the Secretary of the National Union of Workers, Tasmanian Branch (NUW), that the dispute had been resolved and that the hearing was unnecessary. I was informed that the business had been sold to Purity and all NUW members employed by Campbells Cash and Carry were to receive the redundancy payments which had been developed in conference, including those whose services were terminated on 8 November 1991. Accordingly the file is closed.
