Award variation - labour on-costs - 3% occupational superannuation

REASONS FOR DECISION

This was an application made under Section 23 of the Act by the Transport Workers' Union of Australia, Tasmanian Branch (the Union) for an amendment to be made to the occupational superannuation provisions in the Carriers Award (the Award).

The Union advised that as a result of a recent decision of the Commission, granting exemptions under the Award to some companies whereby they were able to contribute to identified superannuation funds other than those specified in the Award, a deficiency had been brought about. The deficiency was that the exemption provisions omitted to specify the amount of contributions the exempted employers should make to the alternate funds.

A simple cross reference to the contributions subclause was sought as a remedy of the deficiency.

The Tasmanian Confederation of Industries agreed to the amendment sought and supported the Union's application.

The parties agreed for the proposed amendment to operate from the first full pay period commencing on or after 3 December 1991.

I endorse the application: the amendment will operate from the agreed date.
