REASONS FOR DECISION

The abovementioned application for registration was lodged by the Tasmanian Newsagents Association Ltd on 8 July 1992.

Following the serving of statutory notices pursuant to Section 63(2)(b) of the Act, a notice of objection to the registration of the applicant body was lodged by The Retail Traders Association of Tasmania on the grounds that:

"We, the Retail Traders' Association of Tasmania, object to the application for registration received from the Tasmanian Newsagents Association on the grounds that we feel there is, at present, ample organisations open to the Newsagents Association to cater for their industrial needs."

In accordance with the requirements of the Act a hearing was convened for the purpose of hearing and determining the objection and the application on 7 October 1992. The hearing was unable to proceed on this date due to the non-attendance of The Retail Traders Association of Tasmania who was the objector in this matter.

Subsequently on 8 October Mr Rice appearing for the objector advised that following discussions with the applicant, the objection was now withdrawn.

Following submissions from Mr Ireland supported by Mr G. Fader of the Tasmanian Newsagents Association Ltd I have formed the view that the application for registration satisfies the requirements of the Act and accordingly it is now granted. A certificate of registration will be issued pursuant to Section 64(1) following the determination by a Commissioner of award interest.
