Award interest - determination

REASONS FOR DECISION

This matter was referred to me by the President under Section 65A(2) of the Act.

The reference followed a letter from the Federated Clerks Union of Australia, Tasmanian Branch (the FCU) to the Registrar who then applied, pursuant to Section 65A(1) of the Act, for leave to recall the Certificate of Registration of the FCU on the ground that the FCU had an interest in the Independent Schools (Non Teaching Staff) Award (the Award); the Award not being specified in the Certificate.

At the hearing, held in accordance with Section 65A(4), the FCU produced evidence that it had complied with the requirements of Section 63(10)(c) of the Act namely it had eligible members covered by the jurisdiction of the Award. The FCU submitted further that the granting of an interest would not prejudice the orderly conduct of industrial relations in Tasmania.

On the basis of earlier undertakings The Federated Miscellaneous Workers Union of Australia, Tasmanian Branch supported the granting of interest in the Award to the FCU.

I am satisfied that the FCU has complied with the requirements of the Act and that the granting of interest in the Award to the FCU would not be against the public interest and I so determine. The Award will be amended as sought, operative from the date of this decision. As required under Section 65A(6) a copy of this decision will be forwarded to the Registrar for attention.
