REASONS FOR DECISION

On 5 December 1991 the Commission established a new award to be known as the Metal and Engineering Industry Award.

During the course of the hearing which gave rise to that decision the parties stated that it was their intention to have sheetmetal working covered by the new award, however, that classification currently appears in the Plumbers Award.

The purpose of this application is to (a) clarify the scope and the definitions in the Plumbers Award to put it beyond doubt the sheetmetal working in the Plumbers Award is only in respect to plumbing work (as defined) in that award, thus enabling sheetmetal working in general to be covered by the Metal and Engineering Industry Award and (b) remove the Metals and Engineering Workers' Union from the parties and persons bound clause contained in the Plumbers Award.

This consent application is endorsed by the Commission as it will eliminate any potential misunderstandings between the Plumbers Award and the Metal and Engineering Industry Award when it is made in its entirety.

The Order giving effect to this decision will follow in due course and will have the same operative date as application T.2757 of 1990 (i.e. the making of the Metal and Engineering Industry Award), on the completion of submissions relating to wage rates and conditions of employment.  To do other than this has the potential of leaving certain employees award free.

The parties will need to ensure that sheetmetal working in general is covered within the definition defining the Metal and Engineering Industry when application T.2757 of 1990 resumes.
