REASONS FOR DECISION

This application was lodged by the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) for the purpose of varying the Nursing Homes Award to reflect the 2.5% Structural Efficiency increase arising out of the State Wage Case of August 1991.

Mr Warwick representing the HSUA took the Commission to the Wage Fixing Principles and demonstrated where there had been compliance with the Structural Efficiency Principle subclauses (a) to (g).

The application was not opposed by Mr Targett from the Tasmanian Confederation of Industries.

I am satisfied, on the submissions presented by the parties, that the application complies with the Wage Fixing Principles and does not offend the public interest requirements of the Act, and therefore, the wage rates appearing in the award will be increased by 2.5%.

The Orders giving effect this decision will follow in due course and will be operative from the first full pay period to commence on or after 23 December 1992.
