Second minimum rates adjustment

REASONS FOR DECISION

This matter concerns an application by The Association of Professional Engineers and Scientists, Australia, Professional Engineers Branch, Tasmania (APEA) to vary the Professional Engineers (Private Industry) Award by applying the second minimum rates adjustment in accordance with the limitations and conditions imposed by the current Wage Fixation Principles.

The first minimum rates adjustment was granted in matter T.3145 of 1991, with effect from the first full pay period to commence on or after 29 July 1991.

As with the first application the APEA has again acknowledged and given an assurance that where overaward payments occur, absorption, to the extent necessary, would apply.

The Tasmanian Confederation of Industries did not oppose the application since it was made in accordance with the Principles and a commitment as to absorption was given.

In all of the circumstances I am satisfied that to grant the application would be consistent with public interest.

Accordingly the award will be varied in a manner consistent with the application.

Operative Date

This variation to the award shall have effect from the first full pay period to commence on or after 19 February 1992.
