s.23 application for award or award variation

Federated Clerks Union of Australia

(T.3695 of 1992)

ELECTRICAL ENGINEERS AWARD

COMMISSION R J WATLING

17 March 1992

Award variation - Removal of all reference to clerical classifications

REASONS FOR DECISION

On 19 February 1992 the Federated Clerks Union of Australia, Tasmanian Branch (FCU) lodged an application with the Commission for the purpose of having all reference to clerks removed from the Electrical Engineers Award.

The effect of such application would see clerical employees in the industry falling within the Scope of this award being covered by the Clerical and Administrative Employees (Private Sector) Award.

This was a consent application and forms part of the restructuring programme for the Electrical Engineers Award.

Given the foregoing and as there was no opposition from any party, the application is granted.

I would now recommend that the FCU make application in accordance with the Act to have their Certificate of Registration withdrawn and reissued with the Electrical Engineers Award removed from that certificate in view of this decision, as it could be said that the organisation no longer has an interest in the award.
