T3763 and T3765
TASMANIAN INDUSTRIAL COMMISSION Industrial Relations Act 1984 Federated Clerks Union of Australia Registrar DAIRY PROCESSING AWARD
Parties and persons bound and registration REASONS FOR DECISION These two applications were jointly heard on 7 May 1992 because they are closely related. Application T No 3765 of 1992 is an application by the Registrar pursuant to Section 65A(1)) of the Industrial Relations Act 1984, for leave to recall the certificate of registration of the Federated Clerks Union of Australia, Tasmanian Branch (FCU) on the ground that the organisation no longer has an interest in the Dairy Processing Award, an award so specified in the certificate. And application T No 3763 of 1992 is an application by the FCU to vary Clause 6, "Parties and Persons Bound", of the Dairy Processing Award by removing its name from that clause. Mrs Dowd for the FCU explained that both applications were justified because they are intended to give effect to an essential part of a structural efficiency agreement to rationalise award coverage. As a consequence of removing clerks from this award they will obtain their wage rates and conditions from the Clerical and Administrative Employees (Private Sector) Award. No other party opposed either application. As this is a consent matter supported by reasons advanced by the FCU I formally declare that the Federated Clerks Union of Australia, Tasmanian Branch, no longer has an interest in the Dairy Processing Award, effective from 7 May 1992 and the file concerning this matter is returned to the Registrar. Similarly I decide to endorse the application to delete the said union from the 'Parties and Persons Bound' clause of this award, with such variation having effect also from 7 May 1992. Order is attached.
