Classification structure - minimum rates adjustment

REASONS FOR DECISION

This was an application made by the Federated Clerks Union of Australia, Tasmanian Branch (the Union) for a new classification structure and the first Minimum Rates Adjustment (MRA) provision to be inserted in Division C - Clerks of Clause 8 of the Public Vehicles Award (the Award).

The Union submitted that this application was consistent with the August 1991 State Wage Case Structural Efficiency Principle requirements. The proposed new classification structure was the same as that now provided in the Clerical and Administrative (Private Sector) Award. The Union also advised that other proposed changes included the introduction of casual and part-time provisions, a new hours clause and an annualised salary agreements clause.

As to the introduction of the MRA process the Union said that agreement had been reached for four instalments to be made at intervals of nine months and for a fifth and final instalment three months after that.

The Tasmanian Confederation of Industries (the Confederation) confirmed that agreement had been reached on all the matters put to the Commission by the Union.

The Confederation produced a draft order as an exhibit and explained its contents.

The Confederation referred to the items mentioned by the Union and commented on them and some other items as follows:

· the MRA increases were to absorb all over-award payments;

· additional payments which had up till now been provided in the Award were to be deleted;

· at present there was a six grade structure provided for, but a seventh grade was still under negotiation;

· there were also significant amendments to the Contract of Employment clause relating to casual and part-time employees;

· the Annualised Salary Agreements clause was not new in that it had previously been introduced in clerical and hospitality awards;

· there was an appendix to be attached to the Award which provided a detailed translation guide for the clerical division;

· there was a MRA introduction schedule and other details included in the appendix. there was a new "adult entry point" provision in the appendix;

The parties confirmed that agreement had been reached for all the amendments to operate from the first full pay period commencing on or after 13 May 1992.

I am satisfied that all the requirements of the current Guidelines of the Commission have been met in this case. The Award will be amended as requested operative from the first full pay period commencing on or after 13 May 1992: this will include the first MRA. It should be noted that the second MRA will only be implemented following a separate application at the appropriate time.
