Award interest - determination - deletion of all references to clerks

REASONS FOR DECISION

These applications were joined at the outset. One (T.3781 of 1992) was for all references to clerks to be removed from the Ice Cream Makers Award (the Award) and for the name of the Federated Clerks Union of Australia, Tasmanian Branch (the Union) to be deleted from the Parties and Persons Bound clause of the Award: the other (T.3784 of 1992) was made under Section 65A(1) of the Act by the Registrar seeking the recall of the Union's certificate of registration on the ground that it no longer had an interest in the Award.

At the hearing the Union advised that it no longer had an interest in the Award because it had been agreed during the latest Structural Efficiency Principle exercise in the Award (matter T3726 of 1992) that all reference to clerks would be deleted and consequently any clerks employed would be transferred to the jurisdiction of the Clerical and Administrative Employees (Private Sector) Award. On the basis of all this the Union sought endorsement of the applications.

The Tasmanian Confederation of Industries confirmed the Union's submissions and supported the applications.

All parties having indicated their agreement to these applications I therefore endorse them and determine that the Union no longer has an interest in the Award.

The Award will be amended as requested and the files returned to the Registrar for attention in accordance with Section 65A(6) of the Act.

The Award amendment will operate from 18 May 1992.
