REASONS FOR DECISION

Applications T.3789 and T.3815 of 1992 were lodged by the National Union of Workers, Tasmanian Branch the Federated Clerks Union of Australia, Tasmanian Branch respectively.

At the commencement of the hearing both organisations sought and were granted leave to amend their applications to have the Rubber Trades Award varied to reflect the second structural efficiency increase arising out of the Oct/Nov 1989 State Wage Case decision.

The parties presented an agreed package, which, in their opinion, was sufficient to increase the wage rates contained in the award.

The package was divided into two parts:

(1) award variations to commence immediately, and

(2) a proposed programme to examine the classifications structures, including their relativities one to another.

The award variations can be summarised as follows:

(1) amend the scope clause to make it more industry specific and to clarify any current misunderstanding as to its application,

(2) amend the annual leave clause to provide for the taking of annual leave to be more flexible,

(3) insert a provision to enable meal breaks to be staggered,

(5) include in the contract of employment clause a provision that will enable the employer to direct employees to carry out duties that are within their limits of competence and training.

(6) introduced new clauses in the award relating to:

(a) award modernisation

(b) workplace consultation

(c) enterprise agreements.

As part of the ongoing programme the parties informed the Commission that they were committed to the implementation of new classification structures consistent with the Structural Efficiency Principles. They submitted exhibit R4 (see attachment) which outlined the proposed structure that was being considered.

This, it was stated, was close to finalisation and the parties were prepared to return to the Commission on 16 June, 1992 to finalise the outstanding issues.

Having considered the submissions of the parties I have arrived at the conclusion that the package taken as a whole, including the ongoing programme, is sufficient to warrant the Commission granting the second structural efficiency increase and I decide accordingly.

These applications conform with the Wage Fixing Principles and the Public Interest requirements of the Act.

The hearing will resume on 16 June, 1992 at which time I would expect the parties to address the issues (a) of the new classification structures and (b) the job descriptions associated with each of the levels contained in the structures, including the relativities one to another.

The Order giving effect to this decision is attached and will be operative from the date agreed to by the parties, i.e. the first full pay period on or after 27 May 1992.

PROPOSED CLASSIFICATION STRUCTURE - RETAILER OF RUBBER GOODS

Tyre Retail Employee Level 1 - Proposed Relativity - 78%

Point of Entry

- New employee

Description

An employee at this level would work under direct supervision and perform routine tasks.

May work individually or as part of a team.

Tasks

Indicative tasks at this level may include:

- general cleaning and labouring

- housekeeping

- assisting other employees

- maintain simple records

Tyre Retail Employee Level 2 - Proposed Relativity - 82%

Point of Entry

- Level 1

- Relevant experience and/or training

Description

An employee at this level works above and beyond an employee at level 1 under direct supervision.

Understands and undertakes basic quality procedures.

May work individually or in a team environment.

Tasks

Indicative tasks at this level may include:

- perform duties using basic written spoken and/or diagrammatic instructions.

- maintains records.

- able to measure accurately.

- able to fit pneumatic and solid tyres.

- operate hand operated transport and lifting devices.

- answer telephone queries.

Tyre Retail Worker Level 3 - Proposed Relativity - 87.4%

- Relevant experience and/or training

Description

An employee at this level works above and beyond an employee at level 2 under routine supervision.

Exercises discretion to their level of skill and training.

Tasks

Indicative tasks at this level may include:

- receiving, despatching, distributing, sorting, checking, and packing of goods.

- basis keyboard skills.

- operate mixing and milling machines.

- setting and drawing kilns.

- preparation and receipt of documentation.

- basic counter sales.

- routine deliveries.

- assist in tyre retreading.

- operate business equipment such as a visual display unit for retrieval of information, photocopier and facsimile machine.

- basic counter sales, including the sale of automotive parts that are incidental to the principle business of the establishment, such as wheels, batteries and exhaust systems.

- soliciting orders for rubber tyres outside the employers place of business.

- wheel alignment (non-trade).

Tyre Retail Worker Level 4 - Proposed Relativity - 92.4%

Point of Entry

- Level 3

- Relevant experience and/or training

Description

An employee at this level works above and beyond an employee at level 3 and requires minimal supervision.

Able to work from complex instructions and exercises discretion in the performance of their tasks.

May assist in the provision of on-the-job training.

Assists in the co-ordination of work within the enterprise.

Is responsible for the quality of their own work.

Tasks

Indicative tasks at this level may include:

- using precision measuring instruments.

- licensed operation of material handling equipment.

- basic (non-trade) maintenance.

- calendar operation.

- utilise basic word processing skills.

- customer service.

- processing of sales orders.

- periodic stock checks and stock reconciliation.

- tyre retreading.

Tyre Retail Worker Level 5 - Proposed Relativity - 100%

Point of Entry

- Trade Certificate

- Certificate of Commercial Studies (TAFE) or equivalent.

Description

An employee at this level exercises the skills obtained through the satisfactory completion of a trade certificate or tradesperson's rights certificate.

Tasks

Indicative tasks at this level may include:

- wheel alignment (tradesperson).

- limited range of automotive mechanical tasks.

- operate equipment incidental to their work.

- perform non-trade tasks incidental to their work.

- maintain payroll file following standard procedures and using existing models/fields of information or a central computer resource.

- sort, process and record transactions, payroll dates, petty cash.

- use software packages (other than word processing packages) to create correspondence and business documents.

Description

- Exercises discretion within the scope of this level.
