Labour on-costs - superannuation - payment of wages clause

REASONS FOR DECISION

This was an application made by the Transport Workers' Union of Australia, Tasmanian Branch (the Union) for an additional subclause to be added to the Payment of Wages clause of the Public Vehicles Award (the Award).

The proposed new subclause was related to the payments required to be made under the superannuation clause of the Award and stated:

"The statement provided by the employer sha I 1 a 7so include the amount of any superannuation contribution made by the employer in accordance with subclause 27(b) herein and the name of the Fund to which any contribution is made."

The Union submitted that the reason for inserting the new subclause was self evident, but especially so where, as in the Award, there was a provision allowing for exemptions so that contributions could be made into superannuation funds other than the one specified in the Award.

The Tasmanian Confederation of Industries advised its consent to the application and concurred with the submissions put by the Union.

Both parties sought for the proposed amendment to come into operation from the first full pay period to commence on or after 23 June 1992.

I accept the Union's submissions and grant this application: it does not offend x-m' ciples of the Commission and it is not against the public interest as outlined in Section 36 of the Act.

The amendment will operate from the first full pay period to commence on or 23 June 1992. Order
