Award variation - Structural Efficiency Principle - Special Case Principle - further award restructuring and structural efficiency variations - better defined career structure - portability of sick leave entitlement - consent matter - principles satisfied - application granted - FFPP 1 August 1992 REASONS FOR DECISION This application by the Tasmanian Catholic Education Employees' Association seeks to vary the Catholic Education Award in a manner consistent with the requirements of both the Structural Efficiency Principle and the Special Case Principle, as well as Section 36 of the Act (public interest). The matter is one of consent and follows the finding of an "arguable special case" in matter TA73 of 1991 and is part of an ongoing exercise to phase in limited wage increases and other award restructuring and structural efficiency measures with better defined career structures for teachers. These issues have already been comprehensively addressed in "Reasons for Decision"1 issued on 13 August 1991, and therefore need to be comprehended as being equally germane to this matter. Since August 1991 there have been further negotiations between the parties resulting first of all in provision being made for the classifications of Laboratory Technicians; Librarians; Library Assistants; and Library Aides2, and subsequently this application. Now the parties agree to vary the award by:
I am satisfied that to accede to this application would be consistent with both public interest and wage fixing principles criteria. Accordingly the award will be varied in the manner sought. Date of Operation: These variations shall come into operation on the first pay period commencing on or after 1 August 1992. Order to follow.
