Scope - Third Minimum Rates Adjustment - Annual Leave Loading - Vehicle Allowance

REASONS FOR DECISION

The present application is to vary the Professional Engineers (Private Industry) Award by:

(a) Applying the third minimum rates adjustment.

(b) Changing the wording of the proviso in Clause 9 - Annual Leave, to clarify the expression "normal rate of remuneration".

(c) Updating the amount of annual leave loading payable in conformity with the existing award formula.

(d) Re-wording existing provisions relating to prohibition of leave loading in respect of fractional entitlements.

(e) Removal of unnecessarily duplicated wording in Clause 18 (k) (ii) Maternity Leave.

(f) Changing the name of the applicant organisation to its changed name, i.e. "Association of Professional Engineers and Scientists, Australia", wherever occurring.

(g) Updating the "Vehicle Allowance" in Clause 26 from 36c. to 38c. in accordance with the existing award formula.

That part of the application going to minimum rates adjustment applies an earlier agreed formula consistent with the relevant Wage Fixation Principle, with properly set relativities earlier determined in matter T.2509 of 1990.

The proposed adjustment is to follow six months from the last similar adjustment and the necessary undertakings as to absorption have again been given. Because of the phasing of increases proper regard has been had to the requirements of public interest criteria.

All other proposals may be categorised as either tidying up or application of earlier determined issues.

Since all matters are also consented to, it is my decision to vary the award in a manner consistent with the application.

Date of Operation

These variations shall come into operation on the first pay period to commence on or after 19 August 1992.
