Registration as an organisation of employers

REASONS FOR DECISION

This application for registration was lodged by the abovenamed association on 2 June 1992 and following the expiry of the required statutory period pursuant to Section 63(6) of the Act no objections to the registration of the applicant had been received.

A hearing was convened for the purpose of determining the application on 17 July 1992 at which Mr R. Joyce, appearing for the Chamber was at pains to present a detailed case in support of the application.

A certificate was tendered showing that Federal registration had been obtained by the applicant on 5 October 1978.

Mr Joyce submitted that whilst the applicant was bound by the Vehicle Industries - Repair, Services and Retail Award 1983 of the Australian Industrial Relations Commission, the award of this Commission stated in its application (Automotive Industries Award) has application to members of the Tasmanian Automobile Chamber of Commerce insofar as clerical employees and commercial travellers are concerned.

Mr Joyce also submitted that it was essential for the applicant to be registered particularly in view of the fact that no other employer organisation dedicated to the motor industry was registered in this State.

Having heard the uncontested submission of Mr Joyce and examined the material presented by way of exhibit I am satisfied that the application complies with the requirements for registration specified in the Act and the application is granted.

A certificate of registration will be issued pursuant to Section 64(1) following the determination by a Commissioner of award interest.
