REASONS FOR DECISION

This was an application by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (the Union) for an amendment to be made to the Produce Award (the Award).

The amendment sought was for the name of the Union to be inserted in the Parties and Persons Bound clause of the Award.

The application followed a decision of a full bench of the Commission in matter T.4087 of 1992 which recognised the amalgamation of the Construction Forestry and Mining Employees Union and The Federated Engine Drivers' and Firemen's Association of Australasia (and another union) to form the Union and cancelled the registration of The Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian Branch in this Commission.

The final step in the amalgamation of the unions, in so far as the Award was concerned, was the substance of the amendment sought in this application.

The Tasmanian Confederation of Industries supported the application. I am satisfied that the application is not against the public interest and it is granted operative from the date of the hearing, 14 January 1993.

It should be noted that, as a result of the decision of the full bench in matter T.4087 of 1992, and in conjunction with this matter and matter T.4167 of 1992 (an application for interest in the Award by the Union), the name of The Federated Engine Drivers' and Firemen's Association of Au sia, Tasmanian Branch will be deleted from the Parties and Persons Bound clause of the Award.
