Industrial Dispute - enterprise negotiations and managements refusal to negotiate on the log of Claims

COMMISSION RECOMMENDATIONS

On April 8 Unions, PMEZ in discussions with the Commission reached agreement on a number of proposals to address issues relating to FIMEE's log of claims for a productivity based wage increase.

Other matters relating to the withdrawal of the bonus and the continuation of the award system and/or reliance on enterprise agreements for regulating conditions of employment and workplace reform were effectively deferred. On that latter issue the unions involved expressed their desire to seek award variations and/or enter into industrial agreements to give effect to changes to conditions of employment and/or productivity and efficiency initiatives. For its part PMEZ indicated that it intended to keep all options open and pursue enterprise agreements where possible.

The issue of regulation by award or Section 55 industrial agreements versus Section 61 enterprise agreements will be further addressed by the parties in their discussions arising from the processes endorsed by the Commission in conference on April 8.

In order to commence the review processes which are designed to facilitate discussions on:-

(1)  the log of claims,

(2)  matters relating to RACE,

(3)  workplace reform leading to enhanced productivity and efficiency,

(4)  the bonus and

(5)  the future regulation of the industrial relationsahip between the parties.

FIMEE is requested by the Commission to convene a meeting of its membership to enable the detailed processes envisaged by the Commission to be discussed and for the Commission's strong recommendation for the lifting of all bans to be considered.

In addition to the foregoing the Commission has endorsed:

    (i)  that a representative group of employees who are members of FIMEE be included in the review processes outlined in the April 8 document.

    (ii)  that discussions between the parties on the review process and other outstanding issues be finalised by April 28. A report back to the Commission has been scheduled for that date.

    (iii)  Employees are to be kept up to date with the discussions taking place between the parties.

    (iv)  where apropriate RACE proposals are to be incorporated in the award or industrial agreements.

    (v)  RACE proposals will not be unreasonably held up. In the event of disagreement, the disputes procedure will be utilised. Unresolved matters will be referred to the Tasmanian Industrial Commission.

A further report back to the Commission has been scheduled for 9.00 am on Friday April 16.
