Award variation - parties and persons bound - Automotive Industries Award, Cement Makers Award, Marine Boards Award, Optical Industries Award, Shipbuilders Award - alteration of union title due to amalgamation of MEWU and VBEFA - amalgamated organisation to be referred to as the Automotive, Metals and Engineering Union - consent matter - awards varied - operative date 15 April 1993

REASONS FOR DECISION

These applications by the then Metals and Engineering Workers Union (the MEWU), which were joined at the outset, were for amendments to be made to the various named awards so that the "Parties and Persons Bound" clauses of each of those awards would be varied by the deletion of the reference to the Vehicle Builders Employees Federation of Australia, Victorian Branch (the VBEFA) and insertion of the name of the Automotive, Metals and Engineering Union (the AMEU) in lieu of the MEWU.

On 5 April 1993 the Registrar of the Commission, in matter TR 450 of 1993, cancelled the registrations of the MEWU and the VBEFA following their amalgamation and consequently issued a certificate of registration in the name of the AMEU. The certificate bore the names of those awards in which both of the deregistered organisations formerly held an interest.

The AMEU, in support of the applications, produced evidence of the Registrar's actions and sought for the named awards to be varied as specified to coincide with the new certificate of registration.

The Shop Distributive and Allied Employees' Association - Tasmanian Branch appeared and advised that it had an interest in the Automotive Industries Award and did not object to the applications by the AMEU in respect of that award.

I am satisfied that the AMEU has complied with all the requirements of the Act relating to amalgamation; the variations sought in the applications are approved. The amendments will operate from 15 April 1993.
