Award variation ‑ clause 6 ‑ parties and persons bound ‑ change of name ‑ consent matter ‑ award varied ‑ operative 1 July 1993
REASONS FOR DECISION
These two applications by the Merchant Service Guild of Australia ‑ Victorian and Tasmanian Branch, were to vary the Shipping Award and the Marine Boards Award by giving effect to the applicant's name change.
Both matters were joined for hearing together.
The background circumstances are that the Merchant Service Guild of Australia (MSG) and the Australian Stevedoring Supervisors Association (ASSA) amalgamated and the latter was formally deregistered to permit the creation of a new body known as The Australian Maritime Officers' Union (AMOU).
Following necessary processes before the Australian Industrial Commission Deputy President Williams deregistered the ASSA by decision dated 2 February 1993 and the Registrar of the Australian Commission subsequently issued a certificate of registration dated 15 May 1993 reflecting the name change.
Also on 25 May 1993 the Tasmanian Registrar effected the same name change to the certificate of registration of the MSG.
At the hearing before me the Tasmanian Chamber of Commerce and Industry indicated its consent to the name change.
In all of these circumstances I accept that it would be consistent with public interest requirements of the Act to approve the application to vary the "Parties and Persons Bound" clause of both awards to reflect the name change requested in both applications.
Date of Operation:
This variation to the Marine Boards Award and the Shipping Award shall have effect on and from 1 July 1993.
The orders giving effect to this decision are attached.
