Registration as an organisation of employees

REASONS FOR DECISION

This application for registration was lodged by the Australian Municipal, Transport, Energy, Water, Ports, Community and Information Services Union - Tasmanian Branch (the ASU) on 30 June 1992.

Following the serving of statutory notices pursuant to Section 63 (2)(a) of the Act, as it then existed, notices of objection to the registration of the abovenamed were lodged by:

    1. The Federated Engine Drivers' and Firemen's Association of Australasia, Tasmanian
        Branch. (Registration cancelled 23.9.92)

    2. The Tasmanian Public Service Association.

    3. Metals and Engineering Workers' Union (Now Automotive, Metals and Engineering Union).

    4. Australian Railways Union (Tasmanian Branch).

A hearing of the objections was delayed to provide the applicant with an opportunity for negotiations with a view to settling the objections raised.

During this period the Industrial Relations Amendment (Enterprise Agreements and Workplace Freedom) Act 1992 was enacted by Parliament and commenced on the 1 March 1993. As part of the enactment Section 63 (6) was omitted from the Industrial Relations Act 1984 thus removing any right by organisations to object to applications for registration. The objectors were advised accordingly on 30 March 1993.

Having regard to the submissions of Mr Mecklenburgh and Mr Patterson at a hearing on 15 April 1993, I am satisfied that the application for registration by the ASU complies with the requirements for registration specified in the Act and the application is now granted. A certificate of registration will be issued pursuant to Section 64 (1) following the determination by a Commissioner of award interest.
