Award variation - making of a new award - various clauses

REASONS FOR DECISION

As indicated in my earlier Reasons for Decision in this matter, the Community Services Award making process has been under way for a considerable period of time. The award was first made in respect of Title, Scope and Arrangement in January 1992. Since that time conditions of employment (not rates of pay) have been added at various times to the award following consent between the parties as to the nature and detail of the variations requested to be made by the Commission.

Following further negotiations between the parties additional conditions of employment clauses have been agreed by them and which were endorsed by the Commission at the most recent hearing in this matter held on 11 May 1994. The inclusion of these latest conditions of employment matters relating to Terms of Employment for part time employees, Hours of Work, Shift Work and Overtime, On Call and Recall and Sleepover, bring to a total of 31 clauses in the award. Whilst more clauses are proposed to be included in the award, quite apart from wage rates and classification levels, the award document now in place extensively provides for regulation of the conditions of employment for employees in the Community Services industry.

The issues relating to classifications, structure and wage rates are the subject of continuing discussions between the parties with a report back to the Commission to take place on 28 June 1994. I have high expectations that these important outstanding matters will have been substantially resolved between the parties by that date.

In the meantime the variations, as outlined in Exhibit ASU 4 tendered to the Commission on 11 May 1994, are endorsed operative from the first full pay period to commence on or after 1 July 1994.
