REASONS FOR DECISION

These applications were made by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU) for the purpose of inserting, in the Building and Construction Industry Award, and the Building Trades Award, the $8.00 arbitrated safety net adjustment determined by the Commission in the State Wage Case decision dated 24 December 1993 (T.4692 of 1993).

These were consent applications and are endorsed by the Commission as they are in line with the State Wage Case decision and the Wage Fixing Principles, and the public interest requirements of the Act.

It must be noted, however, that in presenting the draft orders the applicant foreshadowed that there may be a need to further revisit the two awards, being the subject of this hearing, to deal with the capacity adjustment formula for equipment operators. Mr Clifford, for the CFMEU, was not in a position to finalise his submission, on this aspect of the application, during the course of the hearing.

Just prior to this hearing commencing, the AWU-FIME Amalgamated Union, Tasmania Branch lodged two applications (T.4873 and T.4874 of 1994) dealing with $8.00 per week Safety Net Adjustment. Given my decision in this matter I see no useful purpose being served by listing the applications for hearing, and this was acknowledged by that organisation's representative during the course of hearing the CFMEU's applications.

The orders giving effect to this decision will follow in due course and will be operative from the first full pay period to commence on or after 7 February 1994.
