Industrial Dispute - underpayment of wages

REASONS FOR DECISION

This application by The Australian Meat Industry Employees Union, Tasmanian Branch concerned a dispute with Burnie Master Butchers over redundancy payments.

Mr Swallow appearing for the AMIEU informed the Commission that Burnie Master Butchers were in receivership but notwithstanding a redundancy payment was due to Mr Peter Hansen who was made redundant in October 1993. The Receiver for Burnie Master Butchers was in attendance at the hearing and participated in conference discussions.

Mr Flynn appearing for the Meat and Allied Trades' Federation of Australia (Tasmanian Division) opposed the AMIEU's claim for a redundancy payment to be made to Mr Hansen.

Following a series of discussions with the parties, the Commission concluded that a redundancy payment of 1.1/2 weeks pay for each year of completed service should be made to Mr Hansen on the basis that he was genuinely made redundant on 15 October 1993. The quantum of 1.1/2 weeks for each year of completed service hasexisted in the meat industry, with some adaptations, for at least ten years. Having regard to the circumstances in this matter a departure from this formula" is not warranted. Accordingly I confirm that Mr Hansen is to be paid 6 weeks pay at the rate of $459.10 a week. This rate is the weekly wage rate set out in Division A of the Abattoirs Award for a Slaughterman (other than mutton chain). Therefore the amount to be paid to Mr Hansen shall be $2754.60 gross, representing 4 years completed service from the commencement date of his employment on 31 October 1988 to the date he was made redundant on 15 October 1993, and I so order.
