Award variation - union amalgamation - delete all reference to Australian Workers' Union and Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch - insert The AWU-FIME Amalgamated Union, Tasmania Branch - consent matter - award varied - operative 24 February 1994

REASONS FOR DECISION

These application were lodged by The AWU-FIME Amalgamated Union, Tasmania Branch (AWU-FIME) to vary certain awards by deleting all reference to the Australian Workers' Union, Tasmania Branch (AWU) and the Federation of Industrial, Manufacturing and Engineering Employees, Tasmania Branch (FIMEE) and insert in lieu thereof the name of The AWU-FIME Amalgamated Union, Tasmania Branch.

Mr Cooper for the AWU-FIME tendered an exhibit (C1) which contained a decision of the Registrar of the Commission (TR.459 of 1993) which, amongst other things, cancelled the registration of the AWU and FIMEE and stated -

"...a certificate of registration in the name of The AWU-FIME Amalgamated Union, Tasmania Branch will be issued bearing the name of those awards in which both of the deregistered organisations formerly held an interest."

I am satisfied that the awards named in the application should be varied in the manner sought by the applicant and I decide accordingly.

The Orders arising out of this decision will be drawn by the members of the Commission, who have within their assignment, the respective awards that were the subject of this hearing.

The Orders giving effect to this decision will be operative from 24 February 1994.
