REASONS FOR DECISION

These applications were made by the National Union of Workers, Tasmanian Branch (NUW), The AWU-FIME Amalgamated Union, Tasmania Branch (AWU-FIME) and the Australian Municipal, Administrative, Clerical and Services Union (AMACSU) for the purpose of varying the Rubber Trades Award to reflect the $8 arbitrated safety net adjustment determined by the Commission in the State Wage Case decision dated 24 December 1994 (T.4692 of 1993).

All parties to the award supported the applications and a draft order was tendered showing the effect any increase would have on the award.

Decision

After hearing submissions from the parties I endorse the application and the award will be varied in the manner sought by the applicant as it is consistent with the decision arising out of the State Wage Case dated 24 December 1993, the Wage Fixing Principles and the Public Interest requirements of the Act.

Having granted the applications I note that the restructuring programme for this award has not been finalised as the parties have not returned to the Commission on the completion of the trial period for the new classification structure. As a result, applications T.3789 and 3815 of 1992 still remain open. These applications, along with application T.4965 of 1994, will be relisted for hearing on Tuesday, 12 April, 1994 at 10.30am., with a view to finalising classification structures and minimum rates adjustments.

The Order giving effect to this decision is attached and will be operative from the beginning of the first full pay period to commence on or after 8 March 1994.
