Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment REASONS FOR DECISION This was an application made by the Transport Workers' Union of Australia, Tasmanian Branch (the Union) for the $8 arbitrated safety net adjustment, determined by a full bench of the Commission in the State Wage decision dated 24 December 1993 to be implemented in the Carriers Award (the Award). The Union sought the $8 increase and, in so doing, pointed out to the Commission that, in part, the Award had already been the subject of restructuring under the Structural Efficiency Principle (the SEP). One part, covering refuse collection, had not been reviewed under the SEP and the draft order reflected that. Negotiations were taking place about structural efficiency changes in the refuse collection area the Union advised. There had also been discussions between the parties as to enterprise agreements, but to date nothing had eventuated. The Union also outlined some small additional amendments to the draft order submitted at the hearing. The Tasmanian Chamber of Commerce and Industry Limited (the Chamber) endorsed the submissions of the Union and said that the increase was not against the public interest. The Chamber requested that the increase operate from the first full pay period to commence on or after the date the order was issued. I am satisfied that this application fulfils the requirements of the Commission's Guidelines; the Award will be amended as sought operative from the first full pay period to commence on or after the date of this decision. An order will be issued in due course.
