COMMISSIONER P A IMLACH

3 February 1994

Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment

REASONS FOR DECISION

These two matters were joined for hearing: they were applications by the Automotive, Metals and Engineering Union (the AMEU) and the Australian Municipal, Administrative, Clerical and Services Union (the AMACSU) for the for the $8 arbitrated safety net adjustment, determined by a full bench of the Commission in the State Wage decision dated 24 December 19931 to be implemented in the Automotive Industries Award (the Award).

The AMEU sought the increase and advised the Commission that there had been discussions taking place for quite some time between the parties to the Award concerning changes under the Structural Efficiency principle, but to date nothing definite had been able to be brought to the Commission for endorsement although the AMEU was confident settlement would be reached in the near future.

The AMEU also advised that discussions about an enterprise agreement had already taken place with the motor vehicle dealers in the State: again, to date, no firm results could be reported.

The AMEU produced a draft order and sought for the increase to commence to operate from the first full pay period to commence on or after the date of the decision.

The AMACSU, The Australian Workers' Union, Tasmania Branch and (by facsimile message) the Shop, Distributive and Allied Employees Association, Tasmanian Branch supported the AMEU's submissions and the operative date requested.

The Tasmanian Chamber of Commerce and Industry Limited was not opposed to the two applications and supported the operative date sought.

The applications are in accordance with the State Wage Case decision and are granted operative from the first full pay period to commence on or after the date of this decision.

An order is attached.
