s.23 application for award or variation of award

The AWU-FIHE Amalgamated Union, Tasmania Branch
(T.4855 of 1994)

DAIRY PROCESSING AWARD

COMMISSIONER P A IMLACH

21 February 1994

Wage rates - State Wage Case December 1993 - arbitrated safety net adjustment

REASONS FOR DECISION

This was an application for a hearing by The AWU-FIME Amalgamated Union, Tasmania Branch (the Union) for the $8 arbitrated safety net adjustment, determined by a full bench of the Commission in the State Wage decision dated 24 December 1993 (T4692 of 1993) to be implemented in the Dairy Processing Award (the Award).

The Union, in seeking the increase, submitted that the application was in accordance with all the requirements of the December 1993 State Wage Case decision and the Act. A draft order was produced.

The Union, in seeking the $8.00 adjustment, advised the Commission that the Award had been restructured and discussions as to enterprise agreements between the parties had occurred, but, with no results to date.

The Tasmanian Chamber of Commerce and Industry Limited consented to the applications.

I am satisfied that the applications meet all the requirements of the Act and the Principles of the Commission and the Award will be amended as sought operative from the date of this decision.

The Order giving effect to this decision will follow in due course.
